Once the child custody concerns are decided, there is a good chance that the amount of child support will be in dispute.
Either spouse may request a decision for obligation of child support in Louisiana. When you and your spouse cannot agree on child support, the court will award child support based on what is best for the child’s sake. Unmarried parties with a child may also request support.
Our mission is to make sure your children are provided for and that you are treated fairly in the process. As your attorney, I will see to it that accurate information is presented to the judge as part of the divorce proceedings, or in a hearing for child support modification.
Louisiana Child Support Guidelines
Child support in Louisiana is decided in accordance with Louisiana child support guidelines. Child support payments help fund the necessary expenses of raising a child, such as day care, education costs, health insurance and special medical needs.
The amount of child support in Louisiana is based on the incomes of each parent, and how much time the child spends with each parent. The court system uses a formula to determine the amount of child support awarded, and considers many other factors, including:
- The ability of the parent without custody to pay
- How much financial support is needed by the custodial parent
- The number of children being supported
A judge can deviate from the guidelines when such departure is in the child's best interest. Child support can also be set to cover each parent's share of medical insurance, health care expenses not covered by insurance, costs of private education and extracurricular expenses.
